The following General Terms of Sale (GTS) apply to all orders placed on the MADAFAKA STUDIO website (hereinafter referred to as “the site”). By purchasing our services, you agree to these terms. Please read them carefully.
Purpose
These GTS govern the sale of services offered by MADAFAKA STUDIO, including mixing, mastering, promotional sending, and ghost music production.
Services Offered
MADAFAKA STUDIO offers the following services:
- Mixing and mastering of musical productions.
- Promotional sending to enhance track visibility.
- Ghost production: Track sold with complete distribution rights.
- Sample Pack & Stems
Ordering
To place an order in our shop, the client must:
- Select the desired product on our website.
- Provide accurate and complete information.
- Confirm and pay for the order online.
Pricing and Payment
Prices are listed in euros (€).
The services listed under the PRICING tab (here) are tailored to each client. The client must contact us before all. An invoice will also be issued after our work. MADAFAKA STUDIO reserves the right to change prices at any time, but the price at the time of order will remain applicable.
Service Delivery
Delivery times for services may vary depending on the complexity of the order. MADAFAKA STUDIO commits to delivering services within the agreed time frame.
Terms of Use for Ghost Productions
Ghost productions are sold with the following exploitation rights:
Exclusive Distribution and Commercialization Rights:
The buyer has the right to distribute and commercialize the production under their own name and/or artist alias.Prohibition of Resale:
Resale of ghost productions is strictly prohibited. While the buyer retains distribution and commercialization rights, they may not resell the production to a third party. In the event of a breach of this prohibition, MADAFAKA STUDIO reserves the right to take legal action to protect its rights and those of the creators.Exclusive Ownership:
Once the buyer purchases a ghost production, the production will be automatically removed from sale, ensuring its exclusivity. No other party will have access to or rights over the purchased production.Delivery of Materials:
Upon purchase of a ghost production, the buyer will receive a downloadable ZIP file in their account. This ZIP file will include:- A WAV/MP3 file of the track.
- All stems of the track, allowing the buyer to make their own arrangement, add vocals, or make any desired modifications.
Mixing and Mastering:
Mixing and mastering of the production are not included in the purchase. If desired, the buyer can choose to have these services provided by MADAFAKA STUDIO for an additional cost, or they can engage a provider of their choice.
Refund Policy
No refunds will be issued once payment is confirmed, regardless of the service or product purchased (mixing, mastering, promo sending, ghost production, sample pack, etc.). Once the order is paid, all sales are final, and requests for refunds will not be accepted.
Intellectual Property
All content on the MADAFAKA STUDIO website, such as text, images, and logos, is protected by copyright. Any reproduction, distribution, or unauthorized use is strictly prohibited.
Personal Data
The personal information collected (name, surname, alias, email address) is intended to ensure the processing of orders and service improvement. This information is used exclusively by MADAFAKA STUDIO and MADAFAKA MUSIC and is not sold to third parties. For more information, please consult our Privacy Policy.
Limitation of Liability
MADAFAKA STUDIO shall not be liable for any direct or indirect damages related to the use of its services or the interpretation of ghost productions.
Governing Law and Disputes
These GTS are governed by French law. In the event of a dispute, the client is encouraged to contact MADAFAKA STUDIO first to seek an amicable resolution. If no agreement can be reached, the client has the option to engage in mediation, as per Article L.612-1 of the French Consumer Code, which allows consumers to seek free mediation services to resolve conflicts with professionals. A mediator, agreed upon by both parties, can assist in finding a fair resolution.
If mediation does not resolve the issue, French courts will have exclusive jurisdiction over any legal proceedings related to these GTS.
